Revolt Against TSA!: EPIC, The Electronic Privacy Information Center to Sue TSA Over Naked Full Body Scanners
The Electronic Privacy Information Center announced last week it is suing the TSA over its naked full body scanners. The backlash and the revolt against the TSA continues!
EPIC says there is no legal authority for putting the scanners into the airports. Marc Rotenberg from EPIC has written a letter to the TSA challenging the procedures they used to implement the naked full body scanners, and the answer he received from the TSA may surprise you.
Francine Kerner, TSA Chief Counsel, responded, the "TSA is not required to initiate APA (Administrative Procedures Act) rulemaking procedures each time the agency develops and implements improved passenger screening procedures."
Wow, so there is nothing really stopping the TSA, not even the Fourth Amendment?
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
